Update your REACH dossiers urgently!
Our recent webinar poll showed that 21% of attendees had not updated their REACH dossiers! Should ECHA find a compliance failure, it could lead to problems with your REACH registration and subsequent market access. To address non-compliance with dossier information requirements, ECHA and the European Commission (EC), under the REACH Evaluation Joint Action Plan, are planning on checking 30% of all registered dossiers.
By 2027, ECHA will have scrutinised all EU REACH registrations submitted before 2018.

Meet our expert – Eleonore Delouvrier, Regulatory Consultant
Eleonore has a Master's degree in Ecophysiology & Ecotoxicology from the Sorbonne University and has had several internships in the field of environmental toxicology, during which she contributed significantly to laboratory and regulatory research projects.
Since she joined Ricardo's environmental chemistry team, Eleonore has worked on a variety of projects in environmental hazard assessment of chemicals with a particular focus on persistent, bioaccumulative and toxic (PBT) assessment and testing of complex and difficult substances. Clients greatly appreciate her knowledge on the theory as well as the practical part of these assessments.
Eleonore is experienced in data searching and compilation in scientific and grey literature. She is actively involved in the REACH team, supporting chemical companies to comply with EU and UK REACH regulations.
Revision to CLP for endocrine disruptors and other harmful chemicals has been proposed, and new classifications are expected to be formally introduced in early 2023
The European Commission has proposed a revision to classification, labelling and packaging of substances and mixtures (CLP) Regulation, introducing new hazard classes for endocrine disruptors and other harmful chemicals. The revised act which introduces the new classifications is expected to enter into force early in 2023.
Where these new classifications apply you will need to update your safety data sheets (SDSs), Labels, REACH dossiers and poison centre notifications. The full implications of this new proposed act can be found here.

Defra announces new UK REACH registration submission deadlines
In response to concerns raised by stakeholders around the cost of acquiring the data to complete their UK REACH registrations, and the impact on GB businesses, the UK government has announced that it intends to introduce legislation to extend the registration submission deadlines, across all tonnage bands, by three years (subject to the consent of the Scottish and Welsh governments).
The transitional deadlines for UK REACH apply to organisations who were registrants, downstream users, or distributors under EU REACH before UK REACH was introduced. Click here for the confirmed deadlines for UK REACH registration submissions.

Did you miss the deadline to update your EU SDSs to REACH Annex II requirements?
The deadline to update your EU SDSs as per the new REACH Annex II requirements was 31 December 2022.
Are there any costs of non-compliance?
Outdated EU SDSs are likely to cause significant supply chain issues to businesses. For example, Ricardo has been informed that a Belgian port will not be unloading products which are non-compliant with REACH Annex II. The port has been clear that there will be no flexibility, and that they will be rigidly observing the deadline for compliance.
